Information about these incidents rarely makes it out of the prison, and when it does it is extremely rare that the reports are taken seriously and published. This historical record is important for documenting patterns of abuse, and also for informing people on the streets about what goes on behind the bars.

We hope this information will inspire people to take action and join the fight against the criminal injustice system. While we may not be able to immediately impact this particular instance of abuse, we can work to fundamentally change the system that permits and perpetuates it. The criminal injustice system is intimately tied up with imperialism, and serves as a tool of social control on the homeland, particularly targeting oppressed nations.

CDCR Freezes Elderly Inmates in Retaliation of Grievance Campaigns

I am writing you today in response to an article you published in your Winter 2023 edition of Under Lock & Key No. 80. It’s true grievances don’t work, but it’s not just in Nevada where this is the case – it’s also here in the California Department of Corrections (CDCR). They have become callous and adept in covering up their wrongs; or find some minor significance in order to deny or just throw out our grievance and hold their green line even when they know that it’s a heinous act, which one of their own is committing.

Such is the case here at California Medical Facility (CMF) where C.O. Clark has been subjecting god awful pain and suffering on an aging population by running a gulag with temperatures in the high 30’s and low 40’s throughout the night. Pouring rain and broken windows are in every dorm. C.O. Clark insists on turning off the heater and running the swamp cooler full-blast all night long which has had a detrimental and highly damaging effect on my sciatica. I have spoken to him on numerous occasions but all my talking, explaining, and pleading falls upon deaf ears. What he is in fact doing is operating a gulag here at the California Medical Facility and freezing out the senior/aging population.

This man is a sadomasochist who finds pleasure in inflicting physical and mental pain on the prisoner/patient population simply because he can. I assert that it’s all in retaliation for grievances made last year against Sgt. Perez and Sgt. Huston which I used in support of my thesis of abuse by CDCR under the Color of Law here at CMF in a paper to Solano C.C. in my ENGLISH004 class with Professor Therriault which earned me an A in this course.

All this has resulted in causing me horrific amounts of pain. It’s a tragedy that a man like this should be allowed to wear a badge and be given so much power and authority to torture human beings and unleash such sadistic punishments on a graying population of prisoners/patients such as those of us here at the California Medical Facility. The true guilt and culpability lies with his superiors who are fully aware of his actions and legitimize his narcissism/tyranny. I say this because he has been 602ed for his cruelty of freezing-out the population but staff either cover it up or condone his actions through never acting on said 602 (i.e. Grievance Log #349915/filed 1/9/2023). Both him and his superiors need to be held accountable for their disgraceful actions.

I write this in solidarity with my brothers in Nevada: you are not alone in this struggle. And we also have been dealing with oppression and marginalization by Euro-Amerikan subjugation being subjected to through the so-called self-help groups such as RISE run by LSA (Life Support Alliance). It’s all the same oppressive conditions which are a result of the constitutional based involuntary servitude issue (all which is used with bias) that the legislature and repressive justice system refuses to address. This is negatively effecting the lives of ALL incarcerated people.


MIM(Prisons adds): We received a series of grievances and responses from multiple comrades at CMF regarding this issue of the swamp cooler being used to freeze out prisoners. The response from Reviewing Authority D. Hurley was that this never happened. The comrades then submitted grievance petitions to the department documenting staff “reporting deliberate false information (DOM §31140.6.1).”

The USW campaign to “Demand Our Grievances are Addressed” began in California and continues in California and in many states across the country. The question is can the imperialist United $tates ever provide a functioning grievance system to the people it holds in captivity? The majority of the people being of the oppressed nations occupied by imperialism means the ability to abuse with impunity is part of the ongoing repression of those who have fought for freedom from U.$. imperialism for hundreds of years. The fight for grievances to be heard, as is the fight for national liberation, is a fight to end these oppressive conditions.

CA Extorting Money from Prisoners

I was impressed with the research behind the articles about Suboxone in ULK 75 and 76. I first heard of this substance four years ago when individuals showed up on the yard (at Richard J. Donovan) that were using it. Someone I associated with informed me that it was like methadone and that it was highly addictive. I know that guys here at California Medical Facility are using Suboxone whether it’s prescribed to them or not. In fact, illicit drugs of all types are available here, even during the quarantine lockdown when there were no contact visits allowed!

Also, this facility is holding a food sale to “raise money for the Special Olympics.” The offering of a chicken sandwich, potato chips and a cookie for $22.00 doesn’t seem like a good deal to me. Especially considering that only a small percentage would go to the Special Olympics and that 10% goes to the “Inmate Welfare Fund”. Is this a scam or what!?

An article in San Quentin News on a similar fund raiser reads:

“Prisoners spent $63,000 with 10% of the profits going to a charity.”

I see these sales as another scheme to extract money from prisoners and their families and friends and that the real benefactors for these “charities” are the CDCR.

There is another article in the same newspaper on the GTL tablets that are being pushed on us. I’ve read some of the specifications for these tablets and they are of course cheap pieces of crap. They are entirely dedicated to make GTL money pure and simple. How do companies like GTL get away with it? Here is some key points from the article:

“GTL is the phone service provider for all CDCR prisons…. According to Prison Legal News (PLN), GTL has had to pay out millions of dollars to settle lawsuits over the years for alleged violations of the Telephone Consumer Protection Act of 1991 (TCPA).

“In October 2020 a New Jersey judge approved a $25 million settlement agreement between GTL and New Jersey prisoners who paid up to 100 times the actual phone rate between 2006 and 2016, according to PLN.

“The company has also been sued for charging unlawfully inflated prices for collect calls made by incarcerated people throughout the U.S.”


MIM(Prisons) adds: We whole-heartedly agree with this comrade’s assessment of these money-making schemes. We call this extortion, prisoners are forced to pay higher prices for things because there is no other option for them.

The Chik-Fil-A sandwich with waffle chips and a cookie that CDCR was charging $22 for is about $8 on the street. They’re charging prisoners almost 3 times the normal price! If $2.20 is going to charity, where’s the other $12 going?

The article on GTL tablets claims they offer “secure email”, which is a joke because we know GTL and CDCR staff can read anything you send on those things. In other cases, companies have charged prisoners for things like ebooks that are free in the public domain. GTL loves it because they charge prisoners extortion-level subscription fees for very restricted content, and CDCR loves it because it increases the ease of surveillance. The article also promotes the tablets as pacifiers, like suboxone, to keep the prison population docile.

UPDATE 2: Struggle for CPAP Machines Begins Again as Pandemic Surges

Up until 12 December 2020, the day we as Mexicans celebrate Our Lady of Guadalupe, we had been very fortunate here at California Medical Facility - Vacaville (CMF). That morning I came out at 0500 hrs, for my insulin and it didn’t take long to notice the change, the C.O.’s and nursing staff wearing not just masks, which had become the norm by this time, but wearing face shields and PPE also. Then later that evening when I came out my cell at 1705 hrs. for my insulin C.O. White informed us that someone in T-wing had tested positive for the virus. By 2015 hrs. two more men went down with COVID.

Then came the push to once again take our CPAP breathing machines, and the night of the 13th they came in the middle of the night with their Gestapo tactics to take our breathing machines and most of us resisted and did not have to surrender our DME’s. Then came the threats of 115’s but they had a problem and that was how to justify level II prisoners in Unit IV insulation single cells which is where they put us after we fought to get our CPAP’s back – a fight that MIM was instrumental in our being able to get our DME’s back the first time.

Then they sent a Sgt. to explain: either we surrender our power cords to our CPAP’s or they would cell extract us and thereby confiscate our power cords. So we complied under duress to the confiscation of our DME power cords. This as almost daily they tested us for COVID and constant temperature checks at our cell doors as time after time we were slammed down in our cells. On 15 December, they pulled out 18 more prisoners with COVID, by the 18th we had at least 35 men down with the virus in T-wing and we are hearing this is the same throughout the institution. And the same across the street at Solano State prison, surging. By Christmas T-wing had become like a ghost tier, not many men left. And for those of us left breakfast and dinner meals were coming in brown paper bags, though I must say Christmas dinner was the BEST I have had in years to keep it real. On 27 December, C.O. Smith was telling us that we had 200 prisoners hospitalized and a hundred plus C.O.’s with the virus. My son who is in the hole at Corcoran State Prison tells me that it was surging where he is at as well. He himself got the virus, thank God he is young and healthy and was able to pull through though still feeling some effects of the virus.

On 6 January, while Trump supporters were engaging in acts of insurrection, I am happy to report that I did receive the Coronavirus vaccine. The institution is telling our families that they are returning our DME power cords, however I can tell you I have not seen it, but I can only speak of what is happening here in T-wing as we are still on “modified program” here at CMF at the time of this writing.

Return Life-Saving Machines to Prisoners at CMF

Revolutionary Greetings!

10 April 2020 – Filing my April Report from the California Medical Facility (CMF) at Vacaville, California.

This is a hospital, we are all here because we are high risk medical and most of us are 55+ years of age if not older. And those of us with Obstructive Sleep Apnea suffer from a life-threatening condition for which we require the use of a CPAP/BiPAP breathing machine to allow us to keep breathing as we sleep. Today the California Department of Corrections and Rehabilitation (CDCR), using Gastapo tactics, has come in and confiscated our DMEs (Durable Medical Equipment). Thereby placing all our lives at risk under the color of law.

I requested C.O. Gorbe, our dorm officer who since his assignment to our dorm has made a hostile environment, to make a copy of my health care 602 [grievance form] with supporting documents attached, as is my right before I submitted it. I was denied this request and for this reason I submitted this health care 602 attached to a CDCR 22 form with the CDCR 602 H.C. Grievance. And I have been successful in encouraging others to follow suite and file appeals.

My people have been calling the facility and they are denying these as allegations, refusing to acknowledge to our loved ones this even happened. And telling us this is to prevent the spread of COVID-19. Which makes NO sense. I am not infected and their reporting no cases here at CMF. Yet they are placing our lives at risk of our OSA.

I’m sure this is going on at other facilities within CDCR and I encourage all our brothers and sisters to also file paperwork together we can make a difference!

And contact your loved ones beyond the walls to call in and make the system aware that people outside are aware of their actions. Together let’s hold them accountable for their actions!

These machines help people with life-threatening conditions. I am requesting that prisoners at California Medical Facility be given access to these machines immediately. Can you tell me why these machines were taken away and when we can expect them to be returned?”

MIM(Prisons) adds: As this comrade states ey does not have symptoms of COVID-19. While there are reports online that CPAP machines could spread COVID-19, these patients should be tested for the virus if that is the concern. The fact that COVID-19 is becoming so widespread in prisons is a complete failure of the staff to protect prisoners. With proper practices, prisoners likely would not even be exposed to the virus – in many ways, imprisonment is the epitome of “shelter in place..” Prisoners with existing health conditions need not be put under additional threats to their health.
